You’ve come so far as to be elected to the Board of Trustees for your sectional title complex! You are perhaps asking yourself where to start or perhaps, how to move forward from here. There are various trustee duties and responsibilities that you need to be aware of in order to invest your time adequately to act as an effective trustee.
Managing schemes under the Sectional Titles Act, 1986 (“the Act”) is an increasingly complex task, requiring detailed knowledge of the Act and the prescribed rules and an overall understanding of the South African legal system as well as scheme management practices. The law applicable to scheme management is under constant review. Failing to know and apply the legal requirements for scheme governance may have serious consequences, particularly for professional managing agents.
The course aims to equip trustees with the “tools” necessary to fulfil their fiduciary role as trustees, outlining their duties and responsibilities to effectively run their Body Corporate.
